An analysis by the Union of Concerned Scientists argues that the Trump administration’s offshore wind lease buyouts may have violated five federal laws. The report focuses on deals that allowed developers to exit contracts by paying penalties, which the authors say undermined the Bureau of Ocean Energy Management’s (BOEM) original leasing terms and public revenue expectations.
The five alleged violations include the Federal Land Policy and Management Act, the Outer Continental Shelf Lands Act, the National Environmental Policy Act, and two provisions of the Administrative Procedure Act. The buyouts, critics contend, bypassed standard environmental reviews and reduced transparency in a sector critical to U.S. clean energy goals.
Environmental groups and policy experts now urge the Biden administration to review these leases and enforce stricter oversight. The findings raise questions about the legality of future offshore wind deals and the balance between developer flexibility and public accountability.
